When a law firm represents a client in court proceedings, all efforts are directed toward getting a favorable outcome for the client. However, receiving a positive decision isn’t necessarily the end of the story. Sometimes, after receiving a favorable decision, the decision needs to be defended against being overturned.
This is because court decisions are sometimes appealed by the other party. If a party that received a favorable decision loses on appeal, they could end up losing their positive outcome in the case. The appeals process can be complicated and a law firm must be able to employ effective strategies when defending a past favorable decision on appeal.
Recently, our firm, the Young Ricchiuti Caldwell & Heller, LLC, law firm, was successful in defending a court decision on appeal. The case involved a lawyer who took actions to enforce a confession of judgment provision related to a settlement he reached with two individuals. Following the lawyer’s actions, the two individuals made a request to a Court of Common Pleas to strike and/or open the confession of judgment. The court denied this request.
The two individuals then appealed this denial. The appeal was heard by the Superior Court of Pennsylvania. In the appeal, the individuals made multiple arguments against the lower court’s decision in the matter. In this appeals case, our firm represented the lawyer and argued in defense of the lower court’s decision. The Superior Court of Pennsylvania ultimately ruled in our favor, rejecting the arguments of the two individuals and upholding the lower court’s decision.
In speaking of appeals, in addition to this recent case, one of the attorneys at our firm, Gregory Heller, recently received recognition from the Pennsylvania Association for Justice. Heller was given the George Douglas Amicus Curiae award for outstanding appellate advocacy as Amicus Curiae Counsel.
